An analysis of the SAVE America Act and its implications

For multiple months as of June 2026, one of President Donald Trump’s top legislative priorities has been stuck in Congress. The SAVE America Act is so important to President Trump, he was willing to shut down the government and leave the entire Department of Homeland Security, everything from the TSA to ICE to FEMA, without funding. President Donald Trump has made it clear that any agreement to fund the government that doesn’t include passage of his SAVE America Act will be vetoed. According to the New York Post, President Trump rejected a proposal to fund parts of DHS because it did not include passage of the SAVE America Act. Furthermore, he has threatened to not pass any legislation at all until the SAVE Act passes. On the other side of the aisle, Senate Democrats are threatening to filibuster the bill and kill it with endless amendment. Both sides are digging in their heels and preparing for a legislative battle, all while critical agencies like TSA and FEMA went without funding. So what is the SAVE America Act, and why is it so important?
The SAVE America Act is focused on voter registration for elections. It would require photographic proof of citizenship when registering to vote. According to the US Department of State, this could include birth certificates, a US Passport, a Consular Report of Birth Abroad, a Certificate of Citizenship or a Naturalization Certificate. According to Representative Chip Roy (R-TX.), who sponsored the bill in the House, the SAVE America Act would also implement a national voter ID requirement that is more rigorous than almost every state requirement on the books. While the Act wouldn’t outlaw mail-in voting, the stricter registration requirements could effectively eliminate mail-in voting, especially for this year’s midterm elections. In addition to this, the act would also mandate that states conduct more frequent voter purges and enforce harsher penalties for election workers.
Proponents of the bill like Republicans in the Senate and President Trump argue that these restrictions are necessary in order to maintain election integrity. They focus on claims of undocumented aliens voting in elections. A White House Press Release justifies the Act by citing increased fraud from mail-in voting and popular support for only allowing citizens to vote. However, some of the numbers cited in that release can be misleading. The Brennan Center for Justice found just 30 cases of non-citizens voting in a sample of more than 23.5 million ballots. While recent cases in North Carolina, Arizona, and Georgia, have found evidence for noncitizens voting, they make a marginal impact (less than a 0.001% of votes) and are punished swiftly and harshly under existing laws.
The press release cites support for overall voter ID laws which is also misleading. Many states already have laws to ensure only citizens vote, and these laws are effective without the heightened restrictions the SAVE America Act proposes. This “support” for the voter ID laws does not translate to support for the SAVE America Act. Furthermore, the press release also cites proof of citizenship as widely popular, but every state already has laws to ensure only citizens are able to vote. Representative Roy provides a similar justification, claiming illegal aliens have “ample opportunities to illegally register to vote in Federal elections”. The stated reason for the SAVE America Act is to prevent non-citizens from voting, but there is little evidence to prove this, according to NPR. Non-citizen voting is already extremely rare, and there are already harsh penalties for it. Non-citizens voting in our elections is already an extremely rare and statistically negligible problem that is being handled well under existing laws, which severely undermines the purported reasoning behind the SAVE America Act.
In fact, the SAVE America Act will prevent more citizens from voting than non-citizens. Many Americans aren’t easily able to prove citizenship based on the requirements of the act. Nearly 146 million Americans do not have a passport, and almost 70 million married people have a name different than the one on their birth certificate, according to the NAACP Legal Defense Fund. The law would also effectively eliminate mail-in voting, since it requires in-person registration and less than a quarter of voters register in-person at an election office. Furthermore, the SAVE America Act would require updated proof of citizenship every time someone registers. This would require citizens to go through the entire cumbersome and unnecessary process of providing documentary proof of citizenship every time they register for any federal, local, or state election, according to the League of Women Voters. Both the NAACP, LDF and LVW note that these restrictions don’t affect everyone equally. Women, young people, and poor people are the most likely to be affected. The NAACP even likens the bill to a new poll tax because of the associated fees and difficulties the SAVE America Act would impose on citizens to obtain correct documentation. Coincidentally, the groups who will have the most difficulty voting are those who have a history of voting against Trump. In practice, the SAVE America Act would prevent vast numbers of legitimate American citizens from being able to make their voices heard. It is unnecessary and does far too much to solve a problem so small. Election security is a valid concern, but it is already being effectively protected by the laws currently on the books.
The SAVE America Act passed the House in March. As of June 2026, it has yet to pass the Senate. President Trump has made it clear that passing the SAVE America Act is his top legislative priority, and that he will not sign any other legislation until it is passed. The bill is being filibustered by Senate Democrats, who are committed to ensuring the bill doesn’t pass. According to Politico, some of the more conservative Senators like Mike Lee (R-UT) are advocating abolishing the legislative filibuster to pass the bill with a simple majority, but that is unlikely to happen. It seems for the near future that no legislation will pass through Congress until debate on the SAVE America Act is settled. That means the ongoing partial government shutdown, which is already wreaking havoc on the TSA and air travel, will continue for the next couple of weeks. Long term, the SAVE America Act is unlikely to pass. Republicans will likely try to bring up election security as a talking point during the midterm elections, but the upcoming debate in the Senate will determine how effective that will be.
The SAVE America Act is the Trump administration’s most recent attempt at voter suppression. Ever since his election in 2016, Trump has repeatedly made false claims of voter and election fraud without any evidence. In reality, voter fraud and non-citizens voting are extremely rare and pose no real threat to the security of our elections. The SAVE America Act only serves to make it more difficult for millions of American citizens to make their opinions heard through the democratic process. While it is unlikely the act will pass the Senate, this pattern of voter suppression is extremely troubling from the Trump administration. The fact that Senators are considering overturning the legislative pillar that is the filibuster shows just how far they are willing to go to further Trump’s agenda. By suppressing the votes of those who would dissent against him, the SAVE America Act does not save our democracy or our elections. It only serves to save President Trump from being held accountable by the American people.
